Global Terms of Service & Privacy Policy

1. Scope, Binding Nature, and Modifications

These Terms and Conditions of Service ("Terms") govern the relationship between you (a "User", "player", or "visitor") and Rogue Treasure ("Company", "we", "us", or "our"), regarding your use of the Num Null strategy game, web application, website located at https://www.numnull.com/, and all associated services, leaderboards, APIs, and databases (collectively, the "Service").

Worldwide Applicability: These Terms constitute a binding legal contract globally, governing users regardless of their geographical location. Local laws, directives, or regulations of your country of residence are incorporated only to the extent required by mandatory statutory provisions.

Modifications: We reserve the right, at our sole discretion, to modify, update, append, or delete portions of these Terms at any time. Changes become effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes your explicit and legally binding acceptance of the revised Terms. You are responsible for reviewing these Terms periodically to stay informed of updates.

2. Age Requirements, Eligibility, and Parental Responsibility

Minimum Age: To use this Service, you must be at least thirteen (13) years old. If you reside in a jurisdiction where the minimum age of digital consent is higher (e.g., 16 in certain EEA countries, or 18 in India under the Digital Personal Data Protection Act), you must meet that minimum age requirement.

Parental Consent: If you are under the age of majority in your country of residence (typically 18 years old) but above the minimum digital consent age, your parent or legal guardian must review, accept, and agree to these Terms on your behalf. Parents and legal guardians are jointly and severally liable for all activities, purchases, and behaviors of minors utilizing their accounts on the Service.

Strict Eligibility: We do not knowingly target or permit access to the Service for individuals below the minimum digital consent age without verified parental authorization. If we discover that an ineligible user has accessed the Service, we reserve the right to immediately terminate the account and purge all associated records.

3. User Registration, Security, and Ghost Mode

Authentication Methods: Registration on the leaderboards requires signing in through Google Sign-In (OAuth 2.0). You represent and warrant that the account details accessed via Google are truthful and accurate. You are solely responsible for maintaining the confidentiality and security of your login credentials and Google Account access. We are not responsible for any liability, unauthorized access, or loss of account details resulting from your failure to protect your authentication credentials.

Ghost Mode (Local Profiles): Num Null offers a non-authenticated local profile option known as "Ghost Mode." You acknowledge and agree to the following terms regarding Ghost Mode:

• All progress, settings, earned XP, high scores, purchased Bits, and virtual modifiers (Undos and Flips) are stored strictly inside your browser's local storage database on your specific device.
• This data is **not synced** with our central servers and cannot be migrated to other devices.
• Irrecoverable Data Loss: If you log out of Ghost Mode, clear your browser cache/cookies, delete local storage, reset your browser settings, lose your device, or delete the site files, **all of your progress and purchases will be permanently and irreversibly destroyed**. Rogue Treasure cannot retrieve, refund, or restore any Ghost Mode data under any circumstances.

Account Suspension and Termination: We reserve the absolute, unilateral right to suspend, terminate, restrict, or delete any account, ranking, or access privilege without notice and without liability, for any reason, including but not limited to breach of these Terms, inactivity, or activities deemed detrimental to the gaming community.

4. In-Game Currency & Virtual Purchases (Bits, Undos, Flips)

Virtual Assets License: The Service includes virtual currency ("Bits") and in-game modifiers/power-ups ("Undos", "Flips"). These items are not owned by you. Instead, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use these assets solely within the gameplay parameters of Num Null. You have no property, proprietary, or monetary interest in any Bits or power-ups.

Acquisition and Transfer: Bits can be earned through gameplay events (such as Daily Rewards login streaks) or purchased via integrated billing systems linked to Google Play Store / Apple App Store platforms. Trading, selling, or transferring Bits or items outside the official parameters of the Service is strictly prohibited. Any attempts to engage in secondary markets, selling accounts, or trading virtual items for real-world currency will result in account bans.

Billing and Platform Policies: All financial transactions are processed by third-party billing engines (e.g., Google Play billing). Your transactions are subject to the terms, conditions, and user agreements of the corresponding store platform. Rogue Treasure does not store credit card details or process payments directly.

Refund Policy: **All purchases of Bits and digital modifiers are final and non-refundable.** Under no circumstances will refunds, credits, or exchanges be issued by us, including but not limited to instances of account suspension, server downtime, game modifications, or the deletion of locally stored Ghost Mode data.

5. Rules of Conduct, Anti-Cheat, and Prohibited Activities

To preserve the competitive integrity of global rankings and leaderboards, you agree to comply with all rules of fair play. The following activities are strictly prohibited:

• Cheating and Game Manipulation: Using external software, bots, scripts, hacks, macros, memory-editors, or custom clients to automate moves, artificially inflate scores, modify match timers, or alter gameplay parameters.
• Infrastructure Abuse: Launching Denial of Service (DoS/DDoS) attacks, scanning API endpoints for vulnerabilities, sending malformed payloads, attempting database injections, or brute-forcing accounts.
• Data Harvesting: Scraping, spidering, crawling, or extracting player databases, scores, leaderboard logs, or user emails from the Service using automated software.
• Reverse Engineering: Decompiling, disassembling, deobfuscating, or attempting to discover the underlying mathematical algorithms, server logic, or source code of Num Null.
• Leaderboard Collusion: Win-trading, match manipulation, or utilizing multiple profiles to artificially inflate positions on competitive leaderboards.

Violators will be banned immediately, their scores purged, and their accounts blacklisted. We reserve the right to pursue civil and criminal litigation against individuals attempting to disrupt the Service.

6. Intellectual Property Rights and Submissions

Our Property: All content, source code, designs, layouts, visual illustrations, assets, icons, interactive simulators, logos, copyrights, trademarked names (including "Num Null" and "Rogue Treasure"), patents, database architectures, and algorithms belong exclusively to Rogue Treasure. These are protected under international copyright, trademark, and trade secret treaties. No license is granted to you except for the limited access rights explicitly detailed in Section 4.

User Feedback and Submissions: If you send us feedback, suggestions, reviews, game ideas, or bug reports, you grant Rogue Treasure an unrestricted, perpetual, royalty-free, irrevocable, worldwide, transferable license to use, reproduce, modify, distribute, and commercialize those submissions in any way without compensation, citation, or liability to you.

DMCA & Intellectual Property Claims: If you believe your copyrighted work is infringed by any content on our Service, please submit a detailed takedown notice containing descriptions of the infringed material, location (URL), and your contact details to main@numnull.com.

7. Disclaimers and Limitation of Liability

Warranty Disclaimer: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, ROGUE TREASURE DISCLAIMS ALL WARRANTIES, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND UNINTERRUPTED AVAILABILITY. WE DO NOT GUARANTEE THAT THE LEADERBOARDS, DATABASE, OR MULTIPLAYER LOBBIES WILL REMAIN COMPATIBLE, DURABLE, SECURE, ACCURATE, OR ONLINE AT ALL TIMES.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROGUE TREASURE, ITS DIRECTORS, ASSOCIATES, EMPLOYEES, PARTNERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BITS, XP, PROFITS, REVENUE, GOODWILL, INTERRUPTED GAMEPLAY, OR SYSTEM FAILURE) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION (CONTRACT, TORT, OR OTHERWISE).

Liability Cap: IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE TOTAL SUM OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD) OR THE AMOUNT ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.

8. Indemnification Clause

You agree to indemnify, defend, and hold harmless Rogue Treasure, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of or access to the Service, (b) your violation of these Terms, (c) your infringement of any intellectual property, privacy, or proprietary rights of any third party, or (d) any fraudulent, malicious, or illegal actions performed under your account.

9. Dispute Resolution, Governing Law, and Arbitration

Governing Law: These Terms and any dispute arising out of or related to them shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles.

Venue and Jurisdiction: Subject to the arbitration clause below, you and Rogue Treasure agree to submit to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India, for any judicial actions. You waive any objections to venue or forum non-conveniens.

Informal Resolution First: In the event of a dispute, you agree to contact us first at main@numnull.com to attempt an informal, good-faith resolution. Most concerns can be settled within thirty (30) days.

Binding Arbitration: Any unresolved dispute, controversy, or claim arising out of or relating to these Terms, including the formation, validity, breach, or termination thereof, shall be referred to and finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act of India. The seat and venue of arbitration shall be Hyderabad, India. The proceedings shall be conducted in English by a single arbitrator appointed mutually or by court order.

Class Action Waiver: **You and Rogue Treasure agree that all disputes must be resolved on an individual basis, and you waive the right to initiate, participate in, or act as a class representative in any class-action lawsuit, class arbitration, or representative proceeding globally.**

1. Global Compliance Framework

This Privacy Policy describes how Rogue Treasure collects, utilizes, retains, processes, and protects personal data and privacy settings. We are committed to transparency and adhere strictly to major international data privacy standards, including:

• The General Data Protection Regulation (GDPR) in the European Economic Area (EEA) and the UK GDPR.
• The California Consumer Privacy Act (CCPA) as amended by the CPRA.

We only collect the minimum required data to operationalize matchmaking, secure leaderboards, and ensure secure authentication. We categorize data collected as follows:

• Direct Identity Information (Authenticated Users): When logging in via Google Sign-In, we retrieve your unique Google account identifier, email address, profile name, and Google profile picture URL.
• Gameplay & Telemetry Data: We track play metrics associated with your profile, including game scores, number of moves, time taken to complete boards, active daily login streaks, XP earned, game configuration (e.g., 5x5 Arcade), and history of generated seeds.
• Device and Technical Information: We automatically process logs from your device, including your IP address, coarse location (country-level based on IP), user agent string, web browser type, device operating system version, and system crash logs.
• Local Data (Ghost Mode Profiles): If you choose Ghost Mode, your profile details, active matches, and inventory of Bits are saved locally using HTML5 LocalStorage and SessionStorage. We do not transmit Ghost Mode credentials to our central databases.

3. Purposes & Legal Grounds for Processing

Under regulations like GDPR, we must establish our legal bases for processing data. We process data under the following legal bases:

1. Performance of Contract: To run multiplayer matchmaking, manage your authenticated account, restore virtual purchases, calculate game scores, and update leaderboards.
2. Legitimate Interests: To monitor and prevent hacking, cheat tools, and bots; to maintain system stability and optimize server performance; to perform analytics to understand gameplay difficulty curves.
3. Consent: When you voluntarily register, sign in via Google OAuth, or request account deletions.
4. Legal Obligations: To comply with tax regulations, protect intellectual property, or assist law enforcement.

4. Global Data Transfers and Processing Locations

Rogue Treasure operates from HITECH City, Hyderabad, India. Data collected by the Service is stored and processed on cloud servers managed by tier-1 infrastructure providers (such as Google Cloud Platform or Amazon Web Services) located primarily in India, the United States, and the European Union. By accessing Num Null, you acknowledge and agree that your data may be transferred to and processed in countries outside of your home country, which may possess different privacy regulations than your region. We enforce industry-standard security safeguards, including Standard Contractual Clauses (SCCs) approved by the European Commission, to ensure data is protected globally.

5. User Rights and Data Portability

We respect your rights regarding your personal data. Depending on your jurisdiction (such as the EU under GDPR, or California under CCPA), you have the right to request:

• Right to Access & Copy: You can request a structural copy of your profile data.
• Right to Rectification: You can update incorrect or outdated display names.
• Right to Erasure ("Right to be Forgotten"): You can request that we permanently delete your authenticated account, database logs, and leaderboard standings.
• Right to Object: You can object to processing based on legitimate interests.

6. Browser Cookies, Local Storage, and Security Measures

Cookies and Local Storage: We do not use tracking cookies for third-party advertising. We utilize first-party SessionStorage and LocalStorage to hold secure session identifiers (OAuth tokens), configuration details (dark/light theme choices), and Ghost Mode profile data. You can block or delete storage elements in your browser settings, though doing so will disable authenticated logins and delete local Ghost Mode progress.

Data Security: We deploy industry-standard administrative, physical, and technical controls to safeguard your data. All database communication and client-server traffic is encrypted using HTTPS and Transport Layer Security (TLS 1.2/1.3) protocols. However, you acknowledge that no transmission method over the internet is 100% secure, and we cannot guarantee absolute data security.

Children's Privacy Protection: We comply with US COPPA and global requirements. We do not collect or maintain information from children under 13 (or under 18 in India without parental verification). If you learn that your child has registered without your consent, contact us at main@numnull.com to purge the records immediately.
